Please read in conjunction with our Privacy Policy regarding your personal information.

Throughout the following, ‘we’, ‘us’ and ‘our’ refers to Manta Design (Scotland) Ltd. 

1  General

1.1 We may change these Terms and Conditions at any time, without notice and with immediate effect. Your use of this website is based on an understanding that you accept the Terms and Conditions current at the time of your use.

1.2 Where access to certain website services requires user registration, we may accept or decline such registration at our discretion.

1.3 We advise that you make a copy of these Terms and Conditions for future reference.

2 Order process
 

2.1 All orders to purchase made through this website are subject to our Terms and Conditions.

2.2 The Confirmation stage details your order and includes an estimated dispatch date. We will then email you an order acknowledgement with the same details. Please note that this email does not signify acceptance of your order.

2.3 Dispatch to you of the goods ordered signifies acceptance of your order. Should we be unable for any reason to accept your order, we will notify you at the earliest possible opportunity.

2.4 You may cancel or modify your order at any time up to the date of dispatch. Once dispatched, orders cannot be cancelled or modified.

2.5 We do not store any credit card information. All payment data is processed by PayPal, a certified and accredited payment merchant.

3 Delivery

3.1 Goods are normally shipped within 7 (seven) working days of order acknowledgement. If for any reason your order is lkely to take longer to ship, we will notify you as soon as reasonably possible. 

3.2 All ‘signed for’ goods must be received at the address on the order by an authorised person aged 18 years or over.

3.3 Delivery charges and estimated delivery timescales are specified when you place an order. While we make every effort meet delivery time estimates, where shipping and delivery is outwith our control we can accept no liability for delayed, lost, damaged or misdelivered orders.

4 Payment

4.1 Your payment is taken by PayPal in accordance with PayPal’s Terms and Conditions.

4.2 Goods ordered are subject to availability. If any items are unavailable, we will tell you as soon as possible and immediately issue an appropriate refund.

4.3 The price you pay is the price displayed on this website at the time we receive your order. Exceptions are prices displayed incorrectly for any reason, for example technical issues or unauthorised activity. If we discover an error in the pricing of your order we will tell you as soon as possible and you may either reorder at the correct price or cancel your order. If we are unable to contact you we will treat the order as cancelled. If you cancel and have already paid for the goods, you will receive an immediate full refund.

4.4 All prices shown on our website include value added tax at the current UK rate of 20 per cent. This must be paid by all UK and EU customers.

4.5 If you live outside both the UK and EU, we will not charge you VAT. You may however have to pay separately your own country’s import taxes which will be additional to the VAT-free price you pay us.

4.6 Payment can optionally be made by cheque or bank transfer. In the case of cheque payment, the bank clearing process may significantly delay acceptance of your order. 

4.7 We do not keep any of your card or other personal or financial details after your purchase transaction has been completed. Nor do we sell or pass any personal information to third parties.


5 Returns

5.1 We offer a 30-day money-back guarantee on goods returned unused. Once a saddle has been used it is then second-hand but may be accepted as a return under our Buy-Back service, less our costs including refurbishment if needed (please ask for details, they will be posted here in due course).

Before we consider a Buy-Back, we require that our free setup assistance is taken advantage of via eMail. Unless it is simple advice that is required, we require a side view of the unsatisfactory setup for us to asses the problem more quickly. Most setting issues can be resolved with a little advice on adjustment, and we offer feedback, and advice for specific bikes. If there still is no way to fit the saddle correctly, or, in some cases, unsuitability for a specific application, we may still accept a Buy-Back request. If our terms are not met, we reserve the right to refuse. 

5.2 In the event that you receive faulty or damaged goods, please contact us immediately at sales@mantasaddle.uk  We would ask you do not return anything until we ask you to do so. For speed and convenience, we may ask you initially to email photos of the faulty or damaged items. Where there is no claim that the goods were faulty or damaged when we dispatched them, the return shipping cost is not refundable. 

5.2a We provide a 36-month guarantee on all faulty parts not damaged in use. We require images of broken parts, unless they are returned to us.

5.2b If requested by us, once damaged parts are received, and inspected, we will advise you of our proposed remedy. This may range from the supply of replacement parts, rebuilt, or replacement product.

5.3 At our discretion your return shipping cost may be wholly or partly refunded if we find we were at fault.

5.4 We do not support the use of non-standard seat posts as they are known to potentially break saddles (any saddle), especially if not fitted by a professional. Before considering any ‘parallelogram’, or similar type of seat post, please contact us for assistance.

6 Intellectual property

6.1 All copyright, trademarks and other intellectual property rights in our products and websites are owned solely by us. You or others acting on your behalf cannot use or copy them for your own purposes except with our documented permission.

7 Liability and indemnity

7.1 While we use every reasonable means to protect our website from viruses, malware etc, you use it at your own risk.

7.2 While we take every reasonable step to ensure that our products are fully fit for purpose, we cannot be liable for the consequences of any unintended or inappropriate use of our products.

7.3 While we take all reasonable steps to protect your personal and payment data, we cannot be liable for the failure of third parties over whom we have no control to protect your data.


8 Miscellaneous provisions

8.1 The contract between us shall be governed by the laws of Scotland, and any dispute between us will be resolved exclusively in the courts of Scotland. English is the only language offered for the resolution of disputes.

8.2 If you plan to use our products for business purposes, please make sure that you are covered by appropriate insurance, as our own warranties may no longer apply. If in doubt, please ask us for advice about the extent of your and our liability.

8.3 We will accept no liability for any failure to conduct our business to a good standard if that failure is caused by circumstances beyond our reasonable control.

8.4 If any part of these Terms and Conditions is held by any competent authority to be invalid or unenforceable, the validity or enforceability of other parts shall not necessarily be affected.
